Welcome to Dinehere. These Terms of Service ("Terms") govern your use of the Dinehere website generation service ("Service") operated by Fluxter Limited, a company registered in England and Wales (Company No. 13135508) ("we", "us", or "our").
By using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our Service.
2. Service Description
Dinehere provides an AI-powered website generation service for restaurants. Our Service includes:
- AI-powered menu parsing from uploaded images
- Automatic website design and generation
- Website hosting for a period of 5 years from the date of purchase
- A custom subdomain (yourrestaurant.dinehere.ai)
3. Pricing and Payment
The Service is offered for a one-time fee starting at Β£299. This fee covers:
- Complete website generation
- 5 years of website hosting
- SSL certificate and security
Tax Information: Prices displayed to UK and EU customers include VAT. Prices displayed to US customers exclude sales tax, which will be calculated at checkout based on your location. The final price including all applicable taxes will be shown before you complete your purchase.
Payments are processed securely through Paddle, our payment provider. By making a purchase, you also agree to Paddle's terms of service.
4. User Responsibilities
When using our Service, you agree to:
- Provide accurate and complete information about your restaurant
- Only upload images that you have the right to use
- Ensure your menu content is accurate and up-to-date
- Not use the Service for any unlawful purpose
- Not attempt to interfere with or disrupt the Service
5. Acceptable Use
You may not use our Service to:
- Publish illegal, harmful, or offensive content
- Infringe on any third party's intellectual property rights
- Distribute malware or engage in phishing activities
- Impersonate another person or entity
- Engage in any activity that could damage our reputation or Service
We reserve the right to suspend or terminate websites that violate these terms without refund.
6. Intellectual Property
Your Content: You retain full ownership of all content you provide, including menu items, images, and restaurant information. By using our Service, you grant us a license to use this content solely for the purpose of generating and hosting your website.
Our Technology: The Dinehere platform, including our AI technology, website templates, and software, remains our intellectual property. You receive a license to use the generated website for the duration of your hosting period.
Generated Website: You own the content of your generated website. The underlying code and design framework remain our property, but you may use the website freely for your business purposes.
7. Hosting Term
Your website will be hosted for 5 years from the date of purchase. Before your hosting period expires, we will contact you with renewal options. If you choose not to renew, your website will be taken offline after the hosting period ends.
8. Limitation of Liability
To the fullest extent permitted by law:
- Our Service is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid for the Service
- We do not guarantee uninterrupted or error-free service
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
9. Termination
We may terminate or suspend your website immediately, without prior notice, if:
- You breach these Terms
- Your website contains prohibited content
- We are required to do so by law
You may request termination of your website at any time by contacting us. If you terminate within 30 days of purchase, you may be eligible for a refund under our Refund Policy.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
